When it comes to truck accidents, the key is to name as many potential defendants as possible. While the driver will inevitably be one of them, others may include the company, contractors, employers, and insurance companies.
For example, if the driver is employed by a company, either for trucking or shipping or otherwise, that company is liable for the driver’s negligence. Similarly, if the driver is an independent contractor of a bigger company, that company might also be liable for the driver’s negligence if they have stringent supervision policies in place – otherwise, it will be much more difficult to prove. Lastly, although this is much rarer, the manufacturer of the cargo that a truck is transporting could be liable for the driver’s negligence if they failed to properly inform the driver and/or the company of the potential dangers involved with transporting said material.
